1. Services

Square One Creatives provides professional real estate media services, including but not limited to: photography, videography, aerial/drone imaging, 3D virtual tours, floor plans, photo editing, branding content, and social media content ("Services"). All Services are subject to availability in your area.

2. Booking & Scheduling

Bookings are accepted through our online platform at plus.squareonepros.com. By submitting a booking, you represent that you have the authority to authorize a shoot at the property listed and that all information provided is accurate.

• Bookings are confirmed upon receipt of payment or an approved invoice
• We reserve the right to reschedule due to weather, unsafe conditions, or other circumstances outside our control
• You are responsible for ensuring property access at the scheduled time

3. Payment

Fees for Services are as listed on our website or as quoted directly. Payment is due at the time of booking or upon invoice, as applicable. We accept major credit cards and other payment methods as indicated at checkout. All prices are in U.S. dollars.

Invoices not paid within 30 days may incur a late fee of 1.5% per month on the outstanding balance. We reserve the right to withhold delivery of completed media until full payment is received.

4. Cancellations & Rescheduling

Cancellation and rescheduling policies are as follows:

• 48+ hours notice: Full refund or no-cost reschedule
• 24–48 hours notice: 50% of the booking fee may be retained as a cancellation fee
• Less than 24 hours / same day: Full booking fee may be retained
• No-show: Full booking fee is forfeited

Weather-related reschedules initiated by Square One will not incur any fee.

5. Delivery & Turnaround

We aim to deliver completed media within the timeframe communicated at booking (typically next business day for standard photography). Delivery timelines for video, 3D tours, and specialty services may vary. Delivery timelines begin after the shoot is completed and do not include weekends or holidays unless otherwise specified.

Delays caused by client requests for revisions, access issues, or force majeure events are not counted against our standard delivery commitments.

6. Intellectual Property & License

Upon full payment, Square One grants you a non-exclusive, non-transferable license to use the delivered media for your intended real estate marketing and promotional purposes, including MLS listings, social media, and your website. This license does not include:

• Resale or sublicensing of the media to third parties without our written consent
• Use of the media for purposes unrelated to the listed property without our prior approval

Square One retains the right to use delivered media in our portfolio, marketing materials, and social media, unless you request otherwise in writing prior to the shoot.

7. Text Messaging Consent

By providing your phone number through our website, booking platform, or other means, and by opting in, you consent to receive text messages from Square One Creatives, including booking confirmations, appointment reminders, service updates, and promotional messages. Message and data rates may apply.

8. User Accounts

You may be required to create an account to use certain features of our platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@squareonepros.com if you believe your account has been compromised.

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Square One Creatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services or these Terms, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of our Services shall not exceed the amount you paid to us for the specific Service giving rise to the claim in the 30 days preceding the claim.

11. Indemnification

You agree to indemnify and hold Square One Creatives, its officers, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in St. Louis County, Missouri.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective date" at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
